VTEL INTERNET ACCESS ACCOUNTS

VTel Internet has available a reasonably priced filtering solution that meets the requirements under the Children's Internet Protection Act (CIPA). VTel's "Sentry" Access accounts allow you to control access to Web sites, chat rooms, or discussion groups based on the IP address of your computer(s). Our filtering solutions can serve as the "technology protection measure" schools are required to implement under federal guidelines by providing the hardware and management of the system, while still giving the ability to tailor the level of filtering to meet individual site needs. VTel Internet "Sentry" Access accounts provide a network-based filtering solution that can be used to implement written Internet Access Policies through transparent monitoring, reporting and management of Internet usage. Our implementation utilizes a centralized Cisco Content Engine running SmartFilter Internet Filtering software. Traffic is filtered based on the individual Internet Protocol (IP) address from which Internet access requests are initiated.

The Internet is a worldwide network of computers that contains millions of pages of information. Users are cautioned that many of these pages include offensive, sexually explicit, and inappropriate material. In general, it is difficult to avoid at least some contact with this material while using the lnternet. Even innocuous search requests may lead to sites with highly offensive content. Additionally, having an e-mail address on the lnternet may lead to receipt of unsolicited e-mail containing offensive content. Users accessing the lnternet do so at their own risk and VTel Internet is not responsible for material viewed or downloaded by users from the Internet.

This filtering solution is offered only in conjunction with VTel Internet access accounts. It is available with all account types - dial up, ISDN, DSL, and dedicated.

To initiate Sentry service, customers submit information specifying filtering policies applicable to each individual IP address. These policies are provisioned by VTel Internet. Changes to policies can also be submitted via the same process. The categories available for filtering and a brief description of each are included in attachment A.

The accuracy, completeness, timeliness or correct sequencing of the information obtained from our service is not guaranteed by VTel Internet or any parties transmitting the information ("Information Transmitters"). There may be delays, omissions or inaccuracies in the information. You agree that neither VTel Internet, the Information Providers nor the Information Transmitters shall have any liability contingent or otherwise, for the accuracy, completeness or correct sequencing of the information, or for any decision made or action taken by you in reliance upon the information of the service, or for the interruption of any data, information or aspect of the service. THERE IS NO WARRANTY OF MERCHANTABILITY, NO WARRANTY OF FITNESS FOR A PARTICULAR USE, AND NO WARRANTY OF NONINFRINGEMENT. THERE IS NO OTHER WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, REGARDING THE INFORMATION OR ANY ASPECT OF THE SERVICE (INCLUDING BUT NOT LIMITED TO INFORMATION ACCESS AND ORDER EXECUTION).

LIMITATIONS OF LIABILITY. IN NO EVENT WILL VTel INTERNET, THE INFORMATION PROVIDERS OR THE INFORMATION TRANSMITTERS BE LIABLE TO YOU OR ANYONE ELSE FOR ANY CONSEQUENTIAL, INCIDENTAL, SPECIAL OR INDIRECT LOSSES AND/OR DAMAGES THAT RESULT FROM THE INCONVENIENCE, DELAY OR LOSS OF THE USE OF THE SERVICE. EVEN IF VTel INTERNET, THE INFORMATION PROVIDERS OR THE INFORMATION TRANSMITTERS HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES OR LOSSES. YOU AGREE THAT THE LIABILITY OF VTel INTERNET, THE INFORMATION PROVIDERS AND THE INFORMATION TRANSMITTERS ARISING OUT OF ANY KIND OF LEGAL CLAIM (WHETHER IN CONTRACT, TORT OR OTHERWISE) IN ANY WAY CONNECTED WITH THE SERVICE OR THE INFORMATION, WILL NOT EXCEED THE AMOUNT YOU ORIGINALLY PAID FOR THE SERVICE. Neither VTel Internet, the Information Providers or the Information Transmitters shall be liable for any loss resulting from a cause over which such entity does not have direct control, including but not limited to failure of electronic or mechanical equipment or communication lines, telephone or other interconnect problems, unauthorized access, theft, operator errors, severe weather, earthquakes, and strikes or other labor problems. SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS ON HOW LONG IMPLIED WARRANTIES LAST, THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, OR THE EXCLUSION OF CERTAIN IMPLIED WARRANTIES, SO THAT THESE DISCLAIMERS AND LIMITATIONS MAY NOT APPLY TO YOU. THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY ALSO HAVE OTHER RIGHTS, WHICH VARY FROM JURISDICTION TO JURISDICTION.

TERM COMMITMENT. Customer agrees to pay monthly "Sentry" service fees to VTel for a minimum of three years. In the event customer intends to terminate service prior to expiration of the term set forth herein, customer shall provide VTel one (1) month written notice. In the event customer does not so notify VTel, customer shall owe VTel an additional one (1) month of charges in addition to the termination liability outlined here. If the customer terminates service prior to expiration of the term set forth herein, then a termination liability will be due VTel. The termination liability shall be $20.00 per month multiplied by twelve (12) months or the actual number of months the service has been active, whichever is greater.

ATTACHMENT A � FILTERING CATEGORIES

	Categories
	Anonymizers/Translators	Anonymizers enable anonymous Web browsing through an intermediary to prevent unauthorized parties from gathering personal information, but also allow users access to ANY Web page and bypass blocking software. Language translators that provide input of whole URLs for translation also act like anonymizers.� Also included in the Anonymizers/Translators category are HTTP tunneling programs that encapsulate non HTTP traffic in HTTP packets.� Language translators that translate only TEXT are not blocked.







	Art and Culture	Web sites in this category contain virtual art galleries and other cultural topics, such as museums and country customs.


	Chat	This category contains Web-based chat groups.� Chat rooms allow people to come together online to discuss current events, hot topics, and common interests.� This category also includes forums, message boards, discussion groups, guest books that allow threads, and sites for CHAT software downloads.





	Criminal Skills	This category contains sites that either provide instructions for or identify methods to promote, encourage, or provide the skills to commit illegal, criminal activities.� These include bomb-making, lock picking, computer hacking, burglary, murders, rapes, and so on.




	Cults/Occult	This category contains URLs that have topics with information about the occult, cults, and other sects.


	Dating	This category contains dating and relationship topics, such as listings of personal advertisements, tips for attracting a companion, introductions to potential foreign spouses, and online dating services.



	Drugs	Sites in this category provide information on the purchase, manufacturing, and use of illegal or recreational drugs.


	Entertainment	The entertainment category contains URLs devoted to movies, television, music, hobbies, clubs and amusement parks.� The sites can either be fan-club style or sponsored by a company.� This category also includes personal pages of movies and TV shows.




	Extreme/Obscene/Violence	The extreme category contains URLs that may fall into other categories, but are typically extremely violent, gory, or horrific in nature and may be related to sex, bodily functions, obscenity, or perverse activities.



	Gambling	The gambling category contains URLs that encourage placing monetary or other bets on the outcome of games and contests.� It includes sites offereing gaming, bookmaker odds, lottery pages, and bingo.� Fantasy football leagues may also be included in this category, sometimes in combination with the Sports category.





	Games	This category contains URLs whose focus is traditional board games, and role-playing games such as Battleship and Dungeons and Dragons.� The category also includes video and online games, game reviews, and any URLs that promote game manufacturers, such as Mattel.




	General News	The general news category applies to most online news and mainstream publications, such as business, trade and medical journals, as well as high school and university newspapers.� Some internet radio sites are included in the General News category.




	Hate Speech	This category is dedicated to any sort of information that would encourage the oppression of a specific group of individuals.� This inclues such things as derogatory speech against women, minorities and the disabled.



	High Bandwidth	This category contains URLs that are for downloading, uplaoding, or trading of high-bandwidth files.� Media streaming and MP3 download sites are also included in this category if they are entertainment oriented.



	Humor	The humor category contains URLs that intend to be comical or funny.� Theses sites include general jokes, comic pages, and comedy clubs.


	Investing	The investing category contains URLs that deal with personal investments and investment options.� URLs in this category may contain stock quotes, money management forums, online publications, discount brokerage services, trading stock/mutual funds, portfolio set up, and more.


	Job Search	This rapidly growing category contains URLs related to a job search.� It encompasses sites concerned with resume writing, resume posting by individuals, interviewing, changing careers, classified advertising, and large job databases.� It also includes career development, and invidivdual URLs within otherwise uncategorized sites listing opportunities.� For exmaple, many corporate Web pages also list the company's job openings.






	Lifestyle	URLs in this cateogry may contain discussions or material relevant to an individual's personal life, wether it be unique characteristics or orientation.� The sites may include such things as straight men's groups, gay and lesbian discussions, senior citizen clubs, transgender issues, vegetarianism, naturism and more.




	Mature	This category contains URLs that advertise or sell products that require visitors to be of majority age to purchase, such as tobacco, alcohol, and firearms.� Other topics categorized as mature are adult humaor; provocative but not transparent lingerie photos; detailed text and images explaining sexual problems and products; some adult topics in non-fiction, fiction, poetry and entertainment; and some usage of profanity.
